Please read these Terms and Conditions ("Terms") carefully before using fardworks.com (the "Site") or engaging Fard Works LLC ("Fard Works," "we," "us," or "our") for creative services. By accessing the Site or working with us, you agree to be bound by these Terms.
Fard Works LLC is a creative solutions partner based in New York, New York. We provide brand development, content strategy, digital design, video production, influencer and partnership management, and creative operations services to growth-stage brands and marketing teams.
The Site is provided for informational purposes and to facilitate contact with prospective clients. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Site.

Specific creative services are governed by a separate written agreement between Fard Works and the client, which may include a Statement of Work (SOW), project proposal, or Master Services Agreement (MSA). In the event of any conflict between these Terms and a signed client agreement, the signed client agreement shall control.
Nothing on the Site constitutes an offer to provide services. An engagement is only formed upon execution of a written agreement and receipt of any required deposit.
All content on the Site — including text, graphics, logos, images, and design — is the property of Fard Works LLC or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any Site content without our express prior written consent.
Work product created for clients under a signed engagement agreement is governed by the intellectual property terms of that agreement. Unless otherwise specified in writing, Fard Works retains ownership of all creative work until full payment is received, at which point agreed-upon usage rights transfer to the client.
Any non-public information you share with Fard Works in connection with a potential or active engagement will be treated with reasonable confidentiality. We will not disclose your confidential information to third parties except as necessary to deliver services or as required by law. Formal confidentiality terms for active engagements are governed by the applicable client agreement.
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Fard Works does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to modify or discontinue the Site at any time without notice.
To the fullest extent permitted by law, Fard Works LLC, its owner, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, even if advised of the possibility of such damages.
In no event shall our total liability to you for any claim arising from your use of the Site exceed one hundred dollars ($100 USD).
Some jurisdictions do not allow certain limitations of liability, so the above may not fully apply to you.
You agree to indemnify and hold harmless Fard Works LLC and its owner, agents, and contractors from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, or your infringement of any third-party rights.

Fard Works does not endorse and is not responsible for the content, accuracy, or practices of third-party sites. Your use of any third-party site is at your own risk and subject to that site's terms.

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York.
Before initiating formal legal proceedings, both parties agree to make a good-faith effort to resolve any dispute informally by contacting the other party in writing.
We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
